Terms of service

Flank is a service of Flank LLC, a Wyoming limited liability company. "Flank", "we" and "us" on this page mean Flank LLC. These terms cover flankcreative.com, the Flank app, and the ads we make for you. By making your first payment, you agree to them, together with the billing terms shown on the payment page.

The service

• Flank makes AI video ads for your business: the research, the offer, the angle, the video and the editing. What you pay us is our fee, below.
• You run them in your own Meta ad accounts, connected to Flank. You decide whether to run them, where, and how much to spend.
• How many ads we make for you, and when, is up to us.
• Every ad we make is made with AI. We don't promise any particular results from your ads.

Your account

• Flank is by invitation: you answer a few questions on flankcreative.com, and we decide who we work with.
• You must be at least 18 and using Flank for a business.
• You sign in with a code we email you, or with Google. Keep your email account to yourself. You are responsible for what happens under your account, including by teammates you invite. Admins handle the card, the ad accounts and the team; members can see the overview, the bills and the receipts.

Connecting your ad accounts

• You share each Meta ad account with our Business Manager as a partner, with full control. We use that access to read the account's name, currency, time zone and status, its ads and what they're made of, and their daily spend and results.
• We don't change your ads or your account, except to pause the ads that use our creatives when a charge has failed and stayed unpaid, or a charge is disputed.
• While an ad account runs our creatives, keep it connected. If our access stops, the days it misses are billed when it comes back.
• You can remove an ad account in the app. We bill the days still due first.

Our fee

• The rate. A share of the spend Meta reports on ads that use our creatives, at the rate we agree with you. It's in your invite, and the app shows it for each ad account.
• The days. A day is a calendar day in the ad account's own time zone. We bill each day once it's 6 in the morning the next day there, in the ad account's currency.
• What counts. An ad whose video is ours counts in full. In an ad with several videos or images, only our creative's part counts: Meta's own spend figure for it where Meta gives one, otherwise an even split. An ad we can't see inside, such as a boosted post, counts at the share we agree with you. A creative counts from the day we deliver it.
• Meta's updates. Meta can change a day's numbers after the day. We check each day again every day for a week, and once more when it's 30 days old. Any difference is billed as a correction, up or down. After that, Meta's numbers for the day are final.
• Changes to your rate. We may lower your rate at any time, including for days already billed (you'd see the correction). We'll email you at least 7 days before raising it, and a raise only starts once you agree to it in the app.
• Taxes. Our fee doesn't include taxes. You're responsible for any tax your country charges on what you buy from us, such as VAT or GST under the reverse charge.

Paying

• Your first payment is 100 in your ad account's currency (US, Canadian, Australian or New Zealand dollars, or pounds), paid by card through Stripe. It's credit for your first fees. An ad account in another currency gets its own first payment, made the same way. We never charge you in a currency you haven't agreed to.
• Your fees are worked out each day and come out of your credit first.
• After that, we charge your saved card each week for the fees of the week before (Monday to Sunday), usually on Monday, until you stop the charges. A week under 25 waits for the next one, for up to four weeks. If you owe 1,000 or more before Monday, we may charge it then.
• Each charge is emailed to you with a receipt showing what it's for, and shows on your card statement as FLANK LLC* FEES. Every fee is in the app, ad by ad.
• Stripe keeps your card for these charges. We never see your full card number. Your bank may send us your card's new details when it's replaced, so the charges carry on. You can change the card in the app.
• If a charge fails, we email you, and if it stays unpaid we may pause the ads that use our creatives until it's paid.

Closing your account and refunds

• You can close your account in Settings at any time. That stops the charges: we bill the days still due and charge any fees still owed, stop reading your ad accounts, then refund any credit left to the card it came from.
• Fees for days already billed aren't refundable, unless we billed them by mistake. Then we correct the bill.
• A refund can take 5 to 10 business days to show on your card.
• If a charge looks wrong, email us first and we will sort it out. While a charge is disputed with your bank, your account is paused.

The ads we make for you

• You may run the ads we make for you only in the ad accounts you've connected to Flank, while they're connected.
• You confirm you have the right to everything you send us, such as logos, product photos and scripts, and that we may use it to make your ads. You are responsible for the claims your ads make and for how and where you run them. We may turn down anything we can't make lawfully.

Flank text messages

• If you tick "Text me about this" when you answer our questions, Flank texts you about your enquiry and our ad service: our questions, our replies, and follow-ups. Agreeing is not a condition of any purchase.
• Message frequency varies. Message and data rates may apply.
• Reply HELP for help, or email hello@flankcreative.com. Reply STOP at any time to stop: we send one text to confirm, then no more.
• Carriers are not liable for delayed or undelivered messages.
• How we handle your number is in our privacy policy. We never share it with anyone for their marketing.

Our name and work

The Flank name and logo, this website and the app belong to Flank LLC. The service is provided as it is.

Liability

To the extent the law allows, we are not liable for indirect or consequential damages arising from your use of flankcreative.com or the service, and our total liability to you in any twelve-month period is limited to the fees you paid us in that period. Nothing here limits liability that cannot be limited by law.

Changes

If these terms change, we will update this page and the date at the top, and email account holders at least 7 days before a change that matters takes effect.

Law

These terms are governed by the laws of the State of Wyoming.
